§1 Definitions
- For the purposes of these Terms and Conditions, the following definitions apply:
- Service Provider – The operator of the website (www.discover-warsaw.com), which acts as an intermediary in organizing and selling entertainment events, registered as: TOP EVENTS; Okopowa 29b/31; 01-059 Warsaw; NIP: 5272667991; REGON: 525287481 (hereinafter referred to as the “Organizer”).
- Client – An individual ordering specific entertainment events on their own behalf or on behalf of third parties (hereinafter referred to as the “Customer”).
- Participants – A group of individuals participating in specific entertainment events organized by the Service Provider.
- Agreement – A contract concluded between the Service Provider and the Client.
- Subcontractor – A business entity/contractor collaborating with the Organizer.
§2 General Provisions
- These Terms and Conditions define the general terms and conditions of services provided electronically by the Service Provider.
- These Terms and Conditions apply to all entertainment events organized by the Service Provider.
- The Customer is obliged to inform all Participants of the applicable terms and conditions. Event Participants must familiarize themselves with these Terms and Conditions. Failure to do so does not exempt them from compliance. The Customer and Participants must also adhere to the regulations of our Subcontractors.
- The Customer is required to inform all Participants about the details of the event and any associated risks before it begins. The Organizer is not liable for the consequences of the Customer’s failure to fulfill this obligation.
- The Organizer agrees to exercise due diligence in the organization of services.
§3 Booking Conditions
- Entertainment events can be booked via the website www.discover-warsaw.com by completing the booking form for selected attractions or by phone.
- The booking form requires the provision of personal data—name, email address, and phone number—which are necessary for service execution.
- The Customer reviews the details of selected attractions, chooses the date, time, additional features, and estimates the number of Participants.
- After booking, the Customer will receive a confirmation email and SMS for the selected attractions.
- Upon confirmation of the reservation by the Organizer, the Customer is obliged to make a deposit payment to the bank account provided by the Organizer within one business day. The deposit amount is determined individually based on the selected attractions and communicated to the Customer by email.
- The remaining balance for the event must be paid in cash on the day of the event or via bank transfer at least five days prior to the service. The payment method will be determined by the Organizer, who will notify the Customer by email.
- The Agreement is deemed concluded when the deposit payment is credited to the Organizer’s account.
- The deposit payment constitutes acceptance of these Terms and Conditions by the Customer and all Participants.
- Booking requires acknowledgment and acceptance of these Terms and Conditions as well as consent to the processing of personal data.
- Upon request, the Service Provider will issue a VAT invoice, provided the request complies with applicable legal deadlines.
- Event durations are approximate and may vary depending on the date, number of Participants, weather conditions, etc.
- Additional attractions must be selected at least seven days prior to the event. The Customer must inform the Organizer by phone or email to coordinate scheduling.
- The final number of Participants must be confirmed no later than seven days before the event.
- If fewer Participants attend than declared, the Customer is still required to pay for the originally declared number.
- If more Participants attend than declared, the Customer must pay the difference for the additional Participants.
- Events with a minimum Participant requirement must still meet this minimum even if fewer attend; the Customer is obliged to pay for the minimum number.
- The specifics of each attraction may vary depending on the date, group size, weather conditions, etc.
- The website www.discover-warsaw.com is for informational purposes only and does not constitute a commercial offer under civil law.
§4 Participation Terms
- All Participants must be of legal age. The Customer is responsible for verifying this. The Organizer is not liable for the participation of minors.
- Participants must have valid medical insurance in Poland. The Customer is responsible for ensuring this. The Organizer assumes no liability in this regard.
- The Organizer or Subcontractor reserves the right to interrupt the event and remove Participants in cases of:
- Non-compliance with the rules,
- Disregard for instructions or guidelines,
- Inappropriate behavior (e.g., aggression, intoxication, damage to property, etc.).
- If an event is interrupted due to the Customer’s fault, the Organizer is not obliged to issue refunds.
- The Customer is fully responsible for any damages caused by Participants during the event.
- In exceptional circumstances (e.g., Subcontractor withdrawal, force majeure), the Organizer will notify the Customer immediately. No claims for compensation will be accepted in such cases.
§5 Insurance
- Participation in events is at the Participants’ own risk and discretion.
- The Organizer is not liable for accidents during the event.
- Prices do not include accident insurance.
- Customers are advised to purchase accident insurance for high-risk activities.
§6 Complaints
- Complaints must be submitted via email to hello@discover-warsaw.com.
- Complaints should include:
- Customer’s name,
- Email address and phone number,
- Event date,
- Description and reason for the complaint,
- Desired resolution.
- Complaints will be reviewed within 14 days, and the decision communicated via email.
§7 Right to Withdraw
- Preliminary reservations without a deposit are non-binding and can be modified or canceled at no cost.
- After the deposit is paid, withdrawal is allowed, but the deposit is non-refundable. A voucher for the deposit value may be issued.
§8 Data Protection
- Personal data is managed in accordance with Polish data protection law.
§9 Final Provisions
- The Organizer reserves the right to amend these Terms and Conditions.
- Any disputes will first be resolved amicably or via mediation.
- If unresolved, disputes will be subject to the jurisdiction of the Organizer’s local court.
- Personal data is used solely for booking purposes, and Customers have the right to access and correct their data.
